Francisco Penas Moran

Francisco Penas is an Associate Principal based in Madrid office. He joined RBB in 2016 after completing a MSc in Competition and Market Regulation at Barcelona School of Economics and a BSc in Economics at the University of Basque Country. Francisco has advised clients on a variety of competition issues, including mergers and acquisitions, cartel investigation, market inquiries and litigation matters. He has worked on cases before the European Commission, as well as national competition authorities. Francisco has also provided expert testimony in a wide array of cases before Spanish national courts of justice. A Spanish national, Francisco is fluent in Spanish, English and Basque.

In his role as a consultant competition economist, Francisco has advised clients across a wide range of industries and matters related to competition law infringements, regulatory issues and litigation. He has present expert economic evidence before different jurisdictions, including European Commission, Spain, UK, Ecuador and South Africa. He has also provided expert testimony in a wide array of cases before several Spanish courts of justice.

Francisco is very active in the field of litigation. His recent experience includes antitrust damages cases following Article 101 decisions of the Spanish authority in the TV advertising and paper sectors, and of the European Commission in the trucks and telecommunication sectors. He has also been involved in other court and arbitration cases involving complex economic issues in energy, banking and food delivery industries among others.

Francisco’s recent experience also includes a number of Article 101 investigations related to information exchanges and horizontal cooperation agreements. In particular, he has been involved in the following investigations of the Spanish national authority and/or the subsequent court proceedings: road conservation, radiopharmaceuticals, IT services and applications and low and medium voltage cables.

Francisco has also advised clients in merger cases involving both horizontal and vertical issues. His experience in this field comprises cases before the European Comission (Telefónica/Prosegur Alarmas and Zodiac/Fluidra) and the national authorities in UK (Ensco/Rowan) and Ecuador (AkzoNobel/Grupo Orbis).
