In May 2016, the Federal Anti-Monopoly Service of Russia (FAS) announced its decision to unconditionally clear Diebold’s planned acquisition of Wincor Nixdorf in the Russian Federation. RBB advised Diebold alongside law firms Sullivan & Cromwell (London) and ALRUD (Moscow). RBB economists attended meetings with the FAS and submitted a stand-alone expert report concluding that the transaction will not give rise to competition concerns because the merged entity will continue to face strong competition from existing and potential rivals. The deal remains subject to regulatory approval in other countries and is targeted to close in the summer of 2016.
