In 2014 the CJEU delivered the Cartes Bancaires judgement, a fundamental ruling that reassessed the notion of anticompetitive object and has since affected a multitude of sectors and targeted many unsuspected practices.
On 3 April 2025, AFJE and McDermott Will & Emery are running a workshop that will dive into the notion of restriction by object based on the key decisions taken over the past 10 years in France, Brussels, and Luxembourg.
RBB’s Tristan LécuyerTristan LécuyerPartner will join Frédéric Pradelles (McDermott Will & Emery), Rafael Amaro (University of Caen Normandy) and Stanislas de Guigne (co-head of the AFJE Competition Experts Commission) for a discussion on:
Understanding when an agreement or practice has an anti-competitive object
Critical review of the 3 pillars of restriction by object: content, objective, and context
Practical illustrations based on recent cases
Defence strategies against suspicions of anti-competitive behaviour and the role of effect-based analyses
Focus on recent cases on vertical restraints, particularly online sales and resale price maintenance
