Phoenix Tower International acquisition of Cellnex Ireland cleared in Dublin

Following an in-depth Phase II investigation, the CCPC has cleared a deal that combines two of the three leading mobile tower infrastructure operators in Ireland.  Clearance was conditional on divestment of a portfolio of tower sites where the transaction would have reduced the number of local competitors to two or fewer. 

After considering a national theory of harm, and the UK CMA’s approach to remedies in Cellnex/Hutchison, the CCPC’s assessment ultimately focused on local overlaps between the Parties’ sites.  These local overlaps were addressed through a relatively minor divestment package.
