On 26 September, RBB’s Daniel Gore will join fellow industry leaders to look at the latest merger perspectives across the EU, UK and US.
During the session the panel will discuss how the Microsoft/OpenAI partnership is drawing attention in these jurisdictions. Non-notifiable transactions are a topic of interest. In the US, the new Merger Guidelines set criteria for evaluating competitive impact. In the EU, the Commission is not investigating the transaction anymore under the EUMR but under Article 102. In this context, the Court of Justice is expected to rule on Illumina’s challenge in 2024. In the UK, the CMA’s share-of-supply test grants considerable discretion in selectively reviewing transactions for competition concerns.
