FedEx/TNT unconditionally cleared after phase II investigation

In January 2016, the European Commission announced its decision to unconditionally clear FedEx’s proposed acquisition of TNT, following an in-depth phase II investigation.The European Commission conducted a detailed assessment of the markets for international deliveries of small packages to intra-EEA and extra-EEA destinations and concluded that the acquisition will not give rise to competition concerns because FedEx and TNT are not particularly close competitors and because the merged entity will continue to face sufficient competition from its rivals in all markets concerned.  The European Commission also found that the transaction will give rise to verifiable, merger-specific efficiencies due to network cost savings which will benefit customers.RBB Economics advised FedEx alongside law firm Baker & McKenzie throughout the investigation conducted by the European Commission.
